Rabies on The  Constitutional Court table!

Thursday, December 14th 2017, 9.00 o’clock, at the Bucharest Constitutional Court, will be settled  the unconstitutional  exception of No.1/2014 Order and No. 155/2001 O.U.G, regarding the approval for the management of ownerless dogs program.

Our Association is called in court as the exception author, in process with the National Sanitary Veterinary and Food Safety Agency (A.N.S.V.S.A).

Our intention is, and it has been since 2014, to notify the abuse on dog owners and public health, by conditioning the rabies vaccination, which is free and mandatory, through the private and at free negotiation payment of the microchipping and registration in R.E.C.S.-C.M.V.

Thus, those dog owners who can not afford to pay for the microchip implantation and registration, can not even benefit of the free and mandatory vaccination for their dogs. This is, thereby, a form of blackmailing, in which, if somebody wants to get their free rights, has to pay those certain amounts.

We want to point out that the vaccine and the workmanship are made from budget funds and European funds , precisely for encourage rabies vaccination, as part of the national protection actions.

The annual vaccination action takes place between October and February, and all citizens that own animals must get these services for free and without any discrimination between rural and urban areas.

The lack of citizens information about the national interest problems is a constitutional deviation.

R.E.C.S foundation is abusive, useless, without a public auction and created on an astronomical price.

There are two free registers: Agricultural Register and A.N.S.V.S.A. Register- Service of Disease Control.

Veterinarians have the obligation to register the animals in all of these databases.

“Money before public health” is the name of this manipulation.

Consequently, we stand that the action of conditioning a free right, in particular, the rabies vaccination, by paying another service, is unconstitutional.

No. 1/2014 A.N.S.V.S.A. Order- CAN NOT- be above the 42/2004 Sanitary Veterinary Ordinance!!

ART. 1 The defense of animals health, animals protection, prevention of disease transmission from animals to humans […]  represent a state problem and a duty for all inhabitants of the country.

ART. 3 The state supports the defense of animals health, the supervision, prevention and control of disease that can be transmitted from animals to humans, by assuring the institutional and legal framework, the financial resources, the technical-material basis needed for deploying the sanitary-veterinary activities in optimal conditions.
